Spouse visa finances

Post by saminkhan » Mon Jan 31, 2011 2:30 pm

Hi all

My sister has just got the job and she will be applying for her husband's visa in the next few months time. I have few questions and would appreciate if you could help me out.

Circumstances
She is a british national. Her after tax salary is around £1100 per month. She is the joint tenant in a three bed house which she shares with her 5 year old daughter, me and my wife.

1. How many month's statements and payslips she needs to provide. I have heard that three months are ok but are likely to be rejected and it should be at least six months statements.

2. Is her salary enough to pay for her, her daughter and husband. Is there any minimum requirement per person?

3. Although she is the joint tenant according to the agreement, i have always paid the whole amount of rent and she doenst contribute anything towards the rent etc. Will it be good to start charging her any rent before she applies. If yes, how much money she would need left to pay for the maintenance costs etc. e.g. if i charge her £500, she will only have 600 left to pay for all other costs for herself and her family.

Thanks

3 months statements are sometime accepted, butthey really want 6 months statements as that gives them a better indications of one financial circumstances

Yes I think its more than enough in her present circumstances

3. Before you start charging her rent, is he going to be living with you and will confirm this in her husbands application, then you have to first of all make sure that there will be enough accommodation available in teh house for you to live in as she will have to submitt a report of teh house she intens to reside as part of her hubbys application.

If there is enough space in the house, then I would advise you not to charge her any rent and say that she and her husband can live tehre untill such time they are able to afford their own place. That way she will have enough funds available to support her application, cos if you start deducting rent of her from her income, tehn she will probally not support her family. This is a catch 22 sittuation and you have to think carefully what you want to do before you actually do it.

Thanks
