Dear All,

Would really appreciate some help on this.

I married my wife in Pakistan is 2004 and she came to England on a spouse visa in May 2005. We had a son in 2006 and she stayed until August 2007. At this time she was pregnant and so had our son in Pakistan in Feb 2008. Since then she has not been back to England. I have been twice and have regular contact with her and my children.
I am now able to support them financially so would like them to come and live with me.

Based on he fact that she already stayed here as my wife for 2 years, will she be able to apply for an indefinate stay straight away or will i again have to go through a 2year spouse visa and then apply for an indefinate?

As you haven't spent 4 years living together outside of the UK she will only be able to apply for a 2 year spouse visa, not ILE.

Another Q, would it be possible to apply for earlier settlement on this basis or would have to wait until end of spouse visa?

Unfortunately, she has to start all over again and wait until the completion of the two years on another spouse visa.
