MN1 Aplication Form Help!

Hi,

I'm applying for British Citizenship for my Son, I have a problem filling in the MN1 application form. I don't understand how to fill in the section of the British Nationality Act.

I'm a british Citizen. I got my nationality in Hong Kong in 1997. I was born in Hong Kong. I moved to UK in 2007 with my family. All my family members got their ILR From Hong Kong. My husband got his british Nationality in Jan 2011.

My son who's 14 now got his ILR in 2007. He was born in HK (9th Feb 1997).

Now my problem is under which section of the British Nationality Act should I register my son? Do i have to fill in the section 3 of MN1 application form?


Any help will be greatly appreciated. :)

Does your son hold any form of British nationality, such as British National (Overseas)?

When did your son arrive in the UK?

And on what date in 1997 did you become a British citizen?

#no.

#2007 june.

3.what date in 1997 did you become a British citizen?

If your son was born in Hong Kong in early 1997, then how did he end up without any form of British nationality? Does he hold another, non-British nationality?

Hiya,

My son was born on the 9th feb 1997, and so he gained the right of abode in Hong Kong, plus he holds the Pakistani nationality as well. I got my British nationality on 23/04/1998 (under British nationality (Hong Kong) act 1997). My son was born before I got my British nationality. And I did not apply for his British Nationality in 1998. I've applied for his settlement visa in 2007 from HK. He got ILR on 14/04/07.We moved to UK in June 2007.


How did I got my British Nationality:

British Nationality (Hong Kong) Act 1997: British citizenship for BN(O)s not of Chinese descentAnother special group of solely Hong Kong British nationals were the non-Chinese ethnic minorities of Hong Kong. They are primarily people of Nepalese, Indian & Pakistani descent. After the handover to the People's Republic of China, they would not be accepted as inherently being citizens of the People's Republic. They would be left effectively stateless — they would have British nationality and permanent residency and right of abode in Hong Kong, but no right of abode in the UK, nor a right to claim PRC nationality.

The ethnic minorities petitioned to be granted full British citizenship [4], and were backed by several politicians[5] and media[6] The subsequently enacted British Nationality (Hong Kong) Act 1997 [7] gives them an entitlement to acquire full British citizenship by making an application to register for that status after 1 July 1997.

It appears that an application for registration as a British citizen under section 3(1) of the Act would succeed:

- he is under 18;
- he has ILR;
- at least one is a British citizen and the other is also a British citizen (ILR for the second parent would also do);
- he has lived in the UK for 2 years.

Assuming he has not got any problems with the police, registration should normally be granted.
