EEA-4 (PR) Help

Post by princecaan » Thu Jan 27, 2011 9:51 pm

Hi

I came to uk in sep 2004, living in uk continue more then 6 years now.
My dad is Belgium national and i got pakistani passport with dependent visa.
I left my family in july 2010 due to family problem (force marriage), i applied for ILR application in december 2010 without my dad passport and wage slips because i have no contact with my family since i left my home. I received my all application back last week and home office not given any reason.

I have sent them my last 5 years educational documents from oct 2004 till july 2010, wage slips and cover letter as well.

Can any one advice which documents i can send to home office again that they can consider my case.

Thanks

Just to be clear: what you probably have is a residence permit issued under the (old) EEA regulations and you want to apply for confirmation of permanent residence (ILR is a different story and you would have had to pay for it). Unfortunately, you will need passport/ID of your father and also income related information from him.

Thanks for your reply.

I have applied again last week for EEA-4, last time i forget to send them my full last 5 years prof of education. I came to UK when i was 15.

I got 1st visa from Pakistan, then i had second extension from UK for 2 years then i had another extension for 5 years in dec 2008 through my dad. I think home office have enough prof to process my application.

Any one please advice me regarding my case ....Thanks

What advice would you still need? You obviously believe that you have all necessary documents (have you included a document proving the identity of your father) and you have sent off the application already. Now you can just sit and wait.

What makes me think, however, is that you are talking about "extensions". There are no such things on the EEA route. What "visa" do you actually have at the moment?

thanks for ur reply i will tell you everything again

i am from Pakistan and i am a dependant of belgium national. (non-europeon dependant of a europeon national)

i have left my father who is my sponsor

now i have applied for ILR but providing my own details of past 5 years but they sent my application back

i have applied again mentioning dates since i have been here and what i have been doing

i have also mentioned in my application what my father is currently doing i haven't attached any of his identity documents with my application becoz i dont have anything.

what i wana know is suppose if they send my aplication back without ILR can i go to court against their decision

because my solicitor says i am able to apply for ILR on my own.

You still didn't answer what current "visa" you have and you still keep saying that you are applying for ILR. But then you say that you have a "5 year extension" (what is that exactly?) on the basis of your father who has Belgium nationality. Sorry, but you have to be much more precise with that and it shouldn't be too difficult to read what is written on the passport endorsement or tell us what application form you have filled in (the title says EEA4). Otherwise nobody here will be able to help you.

If that is really an application for permanent residence on form EEA4 and the application fails then you should be given a right to appeal. But I suppose your solicitor knows that.
