Hi Ya,
The company I was working for closed down due to reasons known only to them, But they informed us well in time so that we can search for alternative jobs.
And I withdrew my ILR Application because I thought it was best approach as i didnt want my application to be rejected, which meight cause further trouble for me.
Now I have a company which is ready to do my Workpermit.
I have some queries about the possible repercussion of the company closing down
1. As the company i was working is not existing any more will there be any queries about the previous company.
2. Do we need to specifiy anywhere in the workpermit that the previous company is not existing.
3. After i withdrew my ILR, home office hasn't sent me back my Payslips and company letter, So i really dont have them to submit with the workpermit application from the new company.
The new company will be applying for my workpermit in 15 days time(my old workpermit is valid till december 2006)
Could you please suggest what issues i could face because of the situation iam in.

Not sure I understand your reasoning in withdrawing the application for ILR. Can you explain?
Also, how are you affected by the move from 4 years to 5 years to get ILR?

hi john,
I applied for ILR during the last days of working in my company. After 4 weeks I got a letter from homeoffice that they need to do some further investigation in my case and they fwd my application to some other team and it will take more time, by that time my company closed down(22/05/06).
So i was worried and i thought that they meight enquire about the company and consulted with my friends and they suggested that I withdraw my application.
Fortunately i got a good job offer in a another company who are in the process of getting all the documentation to file my workpermit application(in job type is same in both companies).
So i thought of asking for some advice before submiting the application so that we don't get any further problems.

I was qualified for ILR on 22nd March, but i didnt get any appointment. So applied by post on 23rd March.
Now I'm more worried about my next workpermit than waiting for one more year for ILR.

Too late now if the application is withdrawn, but I don't see the problem if IND did enquire about the company .... assuming you were not the Finance Director of the company and had a hand in its collapse. Apart from that I think you should have just let the application run.
But too late now. So your new prospective employer is going to apply for a work permit and given that your employment visa expires in December 2006 you will also need to get a new visa. The reason for that is the move from four years to five years before you can apply for ILR.

My thinking was if the company is nomore operating how can HO approve my ILR?.
Could you please elaborate on chances of getting my new workpermit? If I get WP approval then I need to go for further leave to remain.

I fear that is totally impossible for me to do so, in the sense that I have no knowledge whether the job is in a shortage area, or whether it has been advertised.
The fact that you got a WP in the same job area, what, four years ago(?) does not automatically mean a WP will be issued for the same job now.

iam basically a senior Flash action script developer... which is in great demand and there are vey few of them around to recruit.. ofcourse i understand that software as a whole doesnt come in the shortage category.
the company has been advertising for this position from quite some time regularly. so showing adverts while submiting application is not a problem.
so any suggestions....
