Post by maggie_qq » Sun Jun 04, 2006 5:47 pm

hi there, my boyfriend got the 5 years working visa, we have been stay togather for 2 years. but the first 1 year we stay in france, we r not living togather and we didt have join account, if we got the proof from our college does it work? the second year we were in uk, stay togather in staff house which can be proof by our hotel.(we work in a hotel). In this case, can i apply for the fiance visa?
if i cant get fiance visa which one should i apply? does anybody knows that if i apply for the student visa, i dont get enough money, can he respond me?

I think you are confusing two types of visa here ... Unmarried Partner Visa ("UPV") and Fiancée visa.

Based upon what you post the two of you have not lived together for two years so an UPV is not currently possible.

A fiancée visa? There is no living together requirement. Indeed in many cultures it would be a total taboo for an engaged couple to live together before the marriage.

A fiancée visa is appropriate if the two of you intend to get married in the UK during the 6-month term of such a visa. Is that your plan?

Before commenting upon any visa issue, can you clarify the nationalities of the two of you? And when you say "my boyfriend got the 5 years working visa,", how long has he been living in the UK? And does he have Indefinite Leave to Remain in the UK?

As regards the marriage matter, UK marriage law says that both of the couple need to be at least 18 years of age (except that age is reduced to 16 if the person has parental consent.

In other words .... 16 years of age if parents agree .... from age 18 no parental consent is needed.

But marriage and visa law is now a bit intertwined, so look forward to your answers to my questions above.
