Claiming Child Benefit while receiving SMP and living in EEA

Post by mrsdexi » Thu Feb 10, 2011 12:28 pm

Hi,

I have a specific question. My client is a Polish national who lived in the UK since 2004. She was continuously working since that time and is receiving Child Benefit for her kids. Recently she gave a birth and now she is receiving SMP. She would like to go for a longer holiday to Poland but she would like to know if that decision will affect her Child Benefit entitlement.

Her SMP will end in Nov 2011 and after that time she is coming back to the UK. I found at HMRC website information that you can claim Child Benefit if: you live in EEA country and you pay UK NICs. My client is treated as a worker (SMP), she is paying UK NICs and is going to live few months in EEA country.

Please, help me solve that problem.

Thanks in advance.
