Claiming Benefits while on 5years work permit in UK?

Post by Farrukh14 » Thu Feb 10, 2011 1:17 am

Dear John,
My name is Fred and I'm on 5years work permit in UK from 2007 to 2012.
My wife on spouse visa and we have our daughter age of 2.5y old ( born in UK 2008) and we expecting one more baby to be born soon.
I would like to ask if you can advise if we eligible for any sort of benefits in UK , please?
I'm the only person working at the moment to support the family and my salary hardly covers rent and food at the moment .

Would you kindly advise if there any sort of support I could receive with my current status ?
many thanks
Fred

What is the nationality of you and your wife? Also, prior to coming to the UK, if either of you worked in another country, apart from that of your nationality, please give details.

That being the case, given the "No recourse to Public Funds" Restriction on your visas, you are not entitled to claim any benefits that are within the definition of Public Funds, as in para 6 of the Immigration Rules.

All that will change when ILR is obtained. Then you will be entitled to claim any benefit that your circumstances dictate you are entitled to.

You mention a pregnancy. The good news is that the definition of Public Funds includes no benefits that are maternity-related. So no problem your wife having free NHS prescriptions during the pregnancy and one year after, and the same applies to NHS dentistry for the same period.

But the main thing for you, I suspect, is that no claims for Child Benefit or Tax Credits are possible, not until the ILR is obtained.

I think you are referring to HiPG .... Health in Pregnancy Grant ... but that has now been abolished. That is, nothing at all to do with visa status, no woman now gets HiPG.

hello there
just fellowing this conversation i guess yu get more info from here than anywhere else.
iam non eea hasband of irish/british wife, one daughter born in the uk
iam in kind of same situation ,my wife and i claimed some benefits like JSA,housing benfit, and council tax benefit,
but just befor making eea2 application we stopped all benefits except child benefit ,is that a probleme??

nb;i know some of you may wonder why eea as my wife british too,but because of my unique situation we will always be refused under uk law i overstayed over 7year,so we need to go europeen route.

my seconde question is that my lawyer already produced an official letter stating that iam allowed to work and live in the uk without obtaining consent from HO that right derivefrom eu derective..
how correct my lawyer is?
in that case can i apply for an ni number as all my paper work and passport are with HO?
and is that lawyer letter confirming my immigration statut will do with jobcenter, plus other documents m/c,b/c,my consulate registration, bills etc...?

it willbe very very helpful if some one could get back at me on this one
thanks a lot
