Dear All,

:shock: I just received a sad message (for now) from my HR yesterday. While they review options, I wanted to get myself informed before going for a meeting next week on my options.

:D Basically I'm here on a management training program. This is my second time to be in the UK working. I was first here in 2000 on a TWES permit for a UK Multinational and left for my MBA studies in the USA (small town university) in 2001. I came back on a working holiday maker scheme in 2003 - 2005. Late Nov last year, my company applied for a TWES permit for me (Work Experience side) and which was approved till Sep 2006.

8) Since then my job profile keeps changing in terms fo new tasks/rprojects. My company wants me to stay on (since i'm on the permanent contract) and they applied last week for an extension to my TWES (for the Training side) given that I have begun taking professional qualifications.

:( Yesterday my company got a preliminary response from WP which was a rejection. The letter (read to me over the phone) states that it seems my job role has been changing (unlike what was stated on the original application) and that my role is no longer an addition to staff requirements but actually essential. The letter suggests that my company can appeal but they would require information to prove the contrary or where possible, the company should actually apply for the WP (B&C).

1s Q: Have any of you gone through this before (or know of someone who did)? And succeeded?

2nd Q: Should the company fight to extend the TWES onto the Training side (3 years) or should it go for the Work Experience side (2 years). No guarantee of success!!

3rd Q: Or should the company go for the full WP and request exception circumstances given that they did not have the full idea of my changing role and would have applied for the WP (B&C) if they had known.

4th Q: Would the fact that my company has no offices in my continent and hence it would be pointless for me to go utilize my skills somewhere else not relevant to UK/Company AND that I have had the TWES before and left to utilize the skills somewhere else earlier AND that I'm on a permanent management training program HELP!!!!

Kindly advice. We have a review meeting with HR this Friday. While I may be open to working in a subsidiary in another office in EU, however, I would really like to continue living in the UK.

Not to sure about the switching bit, but you should look into applying for an HSMP (Highly Skilled Migrant Program), this would lift quite a few restrictions that you seem to mention especially if your role in the company is changing.

You can't switch into a B&C work permit from TWES. You would first need to complete at least 12 months outside the UK.

For the policy now, I think you can not switch directly form TWES to B&S work permit.
