Hi!

We were in Home Office today to apply for a ''Dependant of Tier 4 student''. My partner has "old rules" student visa. They advised apply from home country because of changes in law.

However it is still not clear for me and I am still not sure that my partner with old type of student visa can't apply for a visa of Dependant of Tier 4 student...

Just want to be sure, where it is written in law???

Applying from his country is risky for my partner. He is from Pakistan and civil partnership/homosexual relationship are now welcomed here!

Unfortunately they are correct.

See Immigration Rules para 319c h)

(h) An applicant who is applying for leave to remain, must have, or have last been granted, leave:

(i) as the Partner of a Relevant Points Based System Migrant,

(ii) as the spouse or civil partner, unmarried or same-sex partner of a person with leave under another category of these Rules who has since been granted, or is, at the same time, being granted leave to remain as a Relevant Points Based System Migrant
