If that is a possibility then do ensure that you take a photocopy of the name/pic page and also the current UK visa page, before sending off your passport for renewal.
But normally countries realise the importance of visas and whilst they cancel the validity of the expiring passport they do tend to return them.
question is, is there anyway of getting a copy my current passport with the ilr sticker certified by say a solicitor and i can then use this to prove that i have ilr status?
I am going to say no to that. The problem could well be you checking in at a foreign airport. Would you be 100% happy that such a copy, even a certified copy, would be acceptable? I think not. And even if you did get to board the aircraft, I am not at all sure you would get past UK immigration.
So if your cancelled passport is not returned to you then I think you have no option but to pay the £160 or £500 fee.
