Indefinite Leave to Remain OR British Citizenship

Post by jollygood » Mon Feb 21, 2011 5:46 pm

Dear Readers,
I would be grateful for your kind advice regarding the above matter. At the time of our marriage ( 2008), I held EU passport therefore my Husband who is NON EU National was awarded Residence card of a family member of an EEA National. (Valid untill 2013) after his arrival in UK.

Now I have been honoured with British Nationality therefore I am wondering, should my husband apply for Indefinite Leave To Remain (ILR) OR for British Nationality after three years as spouse of British National.
Thank you for your help

There is no ILR for EEA citizens / EEA citizens' family members issued with RCs under EEA regulations. Under EEA regualtions, it is PR (equivalent of ILR).

And to apply for naturalisation as spouse of British citizen, one of the requirements for members in the UK under EEA regulations is to have PR status.

jollygood, have you retained your original citizenship? Or are you now just British?

sushdmehta, thanks for your advice however PR is for EEA family member after five years but we are keen to apply for citizenship after 3 years on the basis of my British status. how can we fulfill (You must be free from immigration time restrictions on the day you make your application) while he is on RC at present.
