Switching to Tier 2 from PSW

Switching to Tier 2 from PSW

I am going to switch into Tier 2 from PSW, with an employer I currently hold employment with. They have not yet applied for a CoS, but will do so soon.

I have a few questions:

1. My current leave expires in a few months, so I am concerned whether I am allowed to continue working for this employer while the application for CoS is being made?

2. I also am planning to continue doing private work (in the same profession), which will count as supplementary work. Do I need to register as Self-Employed to carry on with this Supplementary Work? (We are required to have our own Professional Indemnity Insurance)

3. If I plan to register a limited company while I am working for my current employer, am I allowed (under Tier 2 policies) to carry work on my company? (Given that it is not more than 20 hours a week and I am still managing to work for my employer full-time without compromising my duties)

4. Am I allowed to switch category within the limit of the Tier 2 permission to remain? (i.e. if I have reached my 10-year stay here in the UK)

your allowed to work until the date your leave is expired!

yes, you can make new app for ILR while on tier 2 leave, assuming ILR is still available at the time you are going to make app

Self- Employment under Tier 2 (under 20 hours work)

Thanks - but if self employment is prohibited, it says under Tier 2 we could take on 'Supplementary Work' as long as it is under 20 hours, and this means that we will be paid for the work, surely the only way to pay taxes on these jobs is to register as a self-employed person?

I will still be working full-time under my sponsor, the business is only a sideline.

No self-employment under Tier 2. Period!

Supplementary work may be done as employed (e.g. - part-time) only.
