Can Tier2 switch into PSW ?

Post by macfish » Tue Feb 22, 2011 10:34 am

I am the tier2 visa holder at this moment. on 1st of April.
My PhD degree will be awarded on March. Is it any chance for me to apply PSW to extend my stay in UK?
(in-country or out-country)

Switching to Tier 1 (PSW), not possible (245Z(f)).

Entry clearance as Tier 1 (PSW), perhaps .... unless there is a pre-condition that the qualification must have been obtained while studying in the UK under student / Tier 4 immigration category. See policy guidance to check if any such pre-condition exists and for more details.

there is no precondition that the studying has to be done whilst here as a student/under Tier 4.

See para 69 of the policy guidance:

An applicant can claim 20 points if he/she can establish that the whole of his/her period of study in the United Kingdom for the eligible qualification was completed whilst he/she had leave to enter /remain that was not subject to a restriction preventing him/her from undertaking a course of study and/or research.

HOME OFFICE POLICY GUIDANCE SHOWS THAT:
---------------------------------------------------------
72. Please note, that whilst you may be
eligible for an award of points under this
attribute you can only apply to switch into Tier
1 (Post-Study Work) if you have, or have last
been granted leave to enter or remain as a:
•Student (paragraphs 57 to 62 of the
Immigration Rules);
•Student nurse (paragraphs 63 to 69 of the
Immigration Rules);
•Student re-sitting an examination
(paragraph 69A to 69F of the Immigration
Rules);

•Student writing up a thesis (paragraphs 69G
to 69L of the Immigration Rules);
• Tier 4 migrant (paragraphs 245ZT to 245
ZZD of the Immigration Rules);

If your period of study was undertaken
with leave to enter or remain in any other
category you will need to leave the United
Kingdom and apply for entry clearance from
outside the United Kingdo

SO....DOES IT MEAN I CAN APPLY "PSW" OUT-COUNTRY?? :roll: :roll:

Did you apply from within the UK or overseas?
Life isn't fair, but you can be!
