ILR - Working Holiday Maker to Work Permit

Post by devmanda1ia » Tue Feb 22, 2011 6:21 pm

Hi All,

I read a post on (http://www.immigrationboards.com/viewtopic.php?t=72542) where it referred to switching from WHM to WP in country and the close for ILR starts from the date visa were granted.

The question I have is that I first came to the UK on WHM visa in Feb 2005 and then switched to WP in Feb 2007. To get the stamp on my passport I had to go back to India for entry clearance but the WP approval was done while I was within the country.

Can anyone please advise when did my ILR clock start? Is it from the date WP was approved or is it from the date I first entered the UK from the time WP was approved?

Thanks,

Dev

The date on which you entered UK as a WP migrant, as already mentioned in the same topic you refer to.

Sorry for the confusion but I was in-country when WP was granted. Does it mean the clock starts from the date wp was granted as I was within the country before on WHM visa?

Also to double check WHM doesn't count towards ILR eligibility?

When a "work authorisation" was approved is irrelevant. The key criteria is "residency in the UK" which starts only when you come to live / start living in the UK under a qualifying immigration category!

The response above (already) answers your second query. See also 245E.
