can someone deported from a member state as a failed asylum seeker re-apply under the Eu law to join his kids and wife who is now exercising her right in another member state?

Yes, that is possible.

But be prepared that there could be a serious suspicion that the marriage is a marriage of convenience, especially if the asylum-seeker married after fleeing his country of origin.

It can also be refused on grounds of public policy, public security or public health, but failed asylum-seekers are not normally in these categories.
