Please help : Invalid application because of photos

Please guide me as i just recieved my application back on grounds of photo, as apparently the photos they as returned had ink, i have no idea who can spill that much ink!

I have been given d chance to apply again, I want to know few things like they havnt specified when will they return back my fees!

should i apply from UK or go back to india?

do apply from UK.

Not sure what they are going to do with fees but i suspect you dont need to resubmit fees as you have been given option to apply from UK

edit: correction: i would like to retract my statement "do apply from UK" after reading the letter from UKBA as you no longer have 28-days window to applya s an overstayer

The refusal letter states that , it is considered invalid coz of the photo clause, I recieved it yesturday, also it has no mention of the time frame for resubmitting the application.

it was there fault, and i send them 4 photos all i got was 2 with one in ink, completely blacked out.

exact paras- Arrangements have been made to return the fees which u submitted with this invalid application.
If you choose to resubmit a fresh application, date of pplication will be the date of fresh application submitted.

Reasons why application is invalid
the photograph must be in the format specified as mandatory in the application form

Its a tricky situation as they consider your app as "invalid".

You technically become overstayer from 31st January.

Counting 28 days from that date.... today is 29th day!

If you are 100% sure that THEY tampered with your photos then i think you have a very good case to pursue via your local MP but if you leave UK now, then you will be given ban of 1 year when you make another Entry clearance app. So, contact your MP and get him to pursue your case.

It must be very tough time for you but remain strong and think clearly about your future plan.

its not tricky at all.

ANJI. i have been through this couple of years ago.where mine was sent back after 4 weeks.
i was told to go home and re apply.
but i applied from within the UK with new set of photos with a covering letter obviously appologising for the possible issue it has caused UKBA.
and you should be fine !! do go through the form again and make sure its completed this time.

Your fees will be returned to your home adress within 4 weeeks.. normally 14 days !!!!

Thank you so much, I checked it with a lawyer and he too said its ok, so now m f9, would be reapplying soonest!
