PSW Query !!

This is Suraj from Bangalore,India posting regarding some PSW [ Post Study Work ] queries.

I completed the MSc IT program from Sheffield Hallam University[SHU] last October [ 2010 ] and was hoping to proceed with the Tier1[ PSW ] application next month . But before I did so , I wanted to consult someone on how to proceed with the application as my last Visa application [ Student-extension from within England ] was returned invalid [ Mid-August 2010 ] due to a bank "error" beyond my control and I had to fly back.[Mid-September 2010].

Scenario ::-

1.The bank "error" was that the account was temporarily frozen for reasons best known to them [ "temporary freeze" is all that they said ] and thus the application fee cheque bounced.

2.My previous visa was valid till the 30th of June[2010]. Extension application was filed on the 14th of the same month. So I'm guessing I've made a valid application.

3.I'm aware of the "overstay" problem [ Have I overstayed ? ] and was told that the supporting documents that I have will help me to a certain extent.

4.I haven't got an Overstay stamp on my Passport as the Immigration officer @ Heathrow didn't seem to think I had overstayed.

5.I'm in India right now and the application will be filed from Bangalore.


Supporting Documents -


1.Support-letter from the Student Adviser @ SHU stating my case and how it wasn't my fault.

2.Letter from the bank , stating there was more than enough funds in the account to cover the cheque and the freeze was temporary.

if the time-lapse between the date you received your refusal and the date u left is more than 28 days... then you will be given 1-year ban so be accurate with your dates. mid sept and mid-whatever is not good enough

I'm sorry , my bad.

The refusal letter is dated 05/08/2010 , but I wasn't notified of the same until the 20th of August by the University.

I flew back on 14/09/2010.

I had been to the British Visa application center last week , where after analyzing the documents the representatives said that my case will hold for the PSW Visa as long as I mention the rejection and overstay citing the supporting letters as evidence to prove I wasn't at fault.

I just want to know what my chances are ...........

If your your application was rejected as invalid then you didn't make a valid application and you overstayed from the end of your visa- 30th June, until when you left on 14 September. You have therefore unintentionally overstayed for more than 28 days. You could therefore be subject to a year long ban. However in practice the eco may well overlook your overstay in particular given the circumstances. I think it is the worth making the application.

Exactly what I wanted to hear , as the representatives weren't UKBA per se , but more of an official partner. And with the evidence I have , I'm pretty sure I'll scrape through.

I just have one more query -

Should I check both Overstay and Rejection in the form or would Rejection with overstay explanation suffice ??

Which question numbers on the form are you referring to please?
Section 6.3 and 6.6 - VAF9 form.
