passport expires - what happens

passport expires - what happens

hi guys,

a quick question....my husband's family permit expires in may and we'll apply for EEA2 for him. his passport though expires in june.

my question is: is that ok if we get a new passport for him before we send the application and send both old passport with family permit in it and new passport too with the EEA2 application?

Why would you want to send in the old passport? One valid document is enough.

i thought you need to send in the family permit with the application, which would be in the old passport.. isn't that the case?

But why? Don't you think that the UKBA wouldn't keep records of that? Besides, he could have entered in a different way. Legal entrance is not a requirement under EEA laws.

the reason why i thought we need to send family permit too is that when we applied for that we were told that he will need to apply for EEA2 within 6 months, while family permit is valid.

so prob that wasnt the right info

Yes, totally misinformed. There is no legal obligation to have a residence card in the first place.
