I have Canadian and Greek citizenship and reside in Greece. My fiancee (a Canadian citizen) came to Greece and we were leg***y wed within the 3 month period that non-EU persons are ***owed to stay in the country. Due to misinformation by the Greek Consulate in Canada and the the municipal authorities in Athens, the wedding took place on the last day of the 3 month period. When we went to submit the forms for her residence permit
we were refused because the 3 month period had expired and now she is considered illegal. We have been told that she needs a new entry stamp on her passport and that she must leave the country.

My questions are as follows:
1- Is there anyway around her having to leave?
2- Can she simply leave the EU and re-enter right away or does she have to stay out for a certain period of time?

Any info would be greatly appreciated.

If that is the case then I suspect that she does not need to leave the EU .... but she does need to leave the Schengen area! After all movement around the Schengen area will not produce any passport stamp.

But the 10 countries that joined the EU on 01.05.04 are not yet members of the Schengen area. So it seems to me that the two of you need some honeymoon time in Cyprus, or somewhere else not in the Schengen area.

But leaving Greece and then trying to get back must be subject to a check of Greek immigration law. I would hate her to not be allowed back in!
