when can i apply for indefinite

Post by Janii » Fri Mar 11, 2011 1:07 am

Hello Guys,

I am non EU while my wife is a EU national.
She came to UK in October 2006.
We married in June 2007 in Poland
Then she applied for WRS in June 2007. I applied for FMRS and got it in Nov 2007.
In July 2008, she applied for registration certificate and i applied for Residence Card. We got it in August 2009. My residence card is valid until August 2014.
Now the whole confusion when can i apply for indefinite.
As there are 4 different dates to make my stay of 5 years as EU spouse.
No1 when we started living together in October 2006.
No2 when we married in June 2007 in Poland and then re enter UK in the same week as a couple. We were there only for a week for our wedding.
No3 is November 2007 when I got FMRS.
No 4 is August 2009 when I got residence card for 5 years until august 2014.

I am confuse as to when can i apply for indefinite as i know that you will need to stay for 5 years before you apply.

Anyone have any idea.
Please kindly advise
Thanks

A non-EEA citizen must reside in the UK as a non EEA family memmber for 5 years to qualify for Permanent Residence.

Your wife will have to prove that she has been economically active for a period of 5 years, too.

No 2, but from the day you both entered the UK as a married couple - so you qualify for permanent residence ~ June 2012.
