B-2 Visitor visa with H1B approval?

B-2 Visitor visa with H1B approval?

I hope someone can help me out on this.

I am in UK on a Tier-1 visa since 2008. I applied for a job in US in 2008 and my prospective employer in the US filed my case for H1B which was selected and approved. In the meantime I got a job in UK which I continued and did not apply for the H1B visa stamping. I now want to visit US as a tourist to see my brother. Can I apply for the B2 visit visa and do I need to do anything about the H1B approval?

I don't see why you would need to do anything. It sounds like the employer's petition was approved, but you never applied for the visa. That shouldn't be a problem as far as visiting is concerned.

Thanks Marco. I also thought the same but just wanted a second opinion due to the strict nature of US visa processings.

B1 in lieu of H-1 visa

US Consulate may issue an employment-authorized B1 visa where the work to be undertaken would usually require an H1B visa. This provision is particularly applicable to situations where you may need a non-US company to send a member of staff to the US for a limited period in order to undertake specific projects for you, or where you wish to bring in an employee of an overseas subsidiary, affiliate or parent for a limited period.
