2 Year Spouse Visa And Working Tax Credit

I am a non-EU national married to a British national. My wife doesn't work at the moment. She lost her job shortly before she got pregnant and has been struggling to find work since our child was born. I am therefore the breadwinner for the family but my income is low. She claims child tax credit. I wish to clarify a few things: since I'm the one working, is it possible for me to claim working tax credit? Will it affect my ILR (due in December)?

As regards the reduction of income, has that been reported to the Tax Credits office?

Yes, the child tax credit is being claimed in joint names. May be it'd sound much clearer if I said that it was means-tested.

With regards to your question about reporting the "reduction in income", I'd say No as nothing has really changed since we were assessed for the child tax credit. My wife was unemployed at the time and still is. I just want to find out if I can claim working tax credit since I'm the one working but under immigration control?

You need to report the change of circumstances to the Tax Credits office. Of course Tax Credits are means-tested, and reduction in income could well mean an increase in Tax Credits payable.

Your circumstances are no different from thousands of others. As already pointed out this subject has been covered many times in this Claiming Benefits section of this board. Did you read the "Benefits : affecting ILR? Read this b4 starting new topic." topic before starting your topic? The answer to your question is clearly there.
