TIER 1 - PSW visa appeal - UK

dear all,
i got my uk psw visa rejected due to lack of maintainance funds,
but the Home office has considered the wrong period to what i really intended.

my funds were place on 18 oct 2010 in my account in sri lanka.
i sent my application form on 29 jan 2011.

my bank pass book from srilanka was last updated up to 30 dec 2010
also i sent a letter confirming the balance on 18 jan 2011.

t/4 i have well above the required funds covering a 90 days period from 18 oct 2010 to 18 jan 2011 and even until now the money is still in my account in sri lanka.

but the immigration ppl has considered the last 3 months from my bank pass book - which is 3 months back fm 30 dec 2010.
i beleive i have a great chance in appealing against the decesion,

HAS ANYONE ATTENDED A PSW VISA REFUSAL - APPEAL HEARING ????

I JUST WANT TO KNOW WHAT HAPPENS IN THE HEARING AND WHAT TYPE OF QUESTIONS THEY ASK AND ECT... ????
PLS IF ANYONE HAS PREVIUOS EXPEIRIENCE, PLS SHARE,, IT WUD B VERY GREATFUL...

Unfortunately you will not win an appeal in this case as the funds should have been in your account from 1st October OR
You should have had your passbook updated to 18th Jan or online statements from 31st dec to 18th Jan to show that the amount was always in your account.
They will not consider the letter as it only confirms balance on 18th Jan.

I would advise you to lodge a new application since you have the maintenance funds in your account now for 90 days atleast

I disagree. The appeal is winnable if you can show you did have the funds for a consecutive 90 day period ending no more than one month before the date of the application. You need to make sure the letter from the bank confirms the minimum consecutive balance and not just a balance on a particular date of. You should also make sure the original pass book is available at the hearing.

The appeal process is very simple.

You can appoint a solicitor if you wish(this ofc can be expensive) but as your case is straightforward you yourself can attend it. Go for oral hearing,

The judge will call your name, you face the judge and a representative from Home Office if appointed who will raise questions to whether the judge should deny your appeal.

You give your statements, to why your appeal should be allowed. Theres no great questions the judge shall ask you.

That's it, at the end of the hearingthe judge will give you the answer, some judges do reserve the decision for later and you will get it in the post.
