Refusal of Tire4 Student visa

Refusal of Tire4 Student visa

Hi,

My friends Tire4 student visa was refused saying that he has not provided all the certificate documents mentioned in CAS.
He was given an option ether to appeal or reapply.
It is mentioned that the application should be made before the current leave expires.
His visa expired on 7th March, he received the refusal letter on 10th March.

Is still eligible to reapply, or do you suggest to go for the appeal.

Any advice is really appreciated.

1. If the visa is expired then i wud suggest not to apply.
2. He should use the appeal option and then provide the required documents cuz his stay will be extended under section 3C and he wud not be an overstayer.
3. My question is that if the UKBA saying that he did not provide the documents then which document is that they want and why u friend did not provide it?

Thanks for the prompt reply.

My friend did not provide Secondary School Certificate (10th) and Intermediate Public Examination (10+2).

He was under the misunderstanding that Graduation certificate was self explanatory.

Will there be any problem if he both appeal and reapply?

1. The best thing is to appeal and provide the required documents.

He can't do both. He should appeal as already advised. If he reapplies then he will be an overstayer. As long as he provides the documents at the hearing the appeal should be successful.

I have asked my friend to go through a solicitor. He is charging him £650.

Dont pay for such a straightforward case.

Your friend can do it himself, the reason for refusal is not providing the doucments

Lodge the appeal, send in the documents, or as for Oral hearing, just go and your friend should do fine.

Id suggest a solicitor in a more complexed case not in this one.

650 would be a lot and a waste

Similar issue....

My friend is going to apply Tier 4 General this month from outside UK.

In his CAS the college mentioned only his Bachelors.

So if he gives only the graduation certificate is enuf or he needs to give 10th and +2 certificates (A and O levels)

He only needs to provide the qualifications mentioned in the CAS.
