Actually I came to UK to do my MSc, initially my visa was granted for a period of 14 months from 25 sep 2009 to 10 nov 2010. But my university failed to publish my result before my visa expires. In order to be in UK until getting my results and PSW letter, I have joined a new diploma course and applied for student visa extension, but my visa extension was refused because of some confusions in the bank accounts that I provided. Later on, I appealed against UKBA decision and won the appeal. I got a letter from the AIT last week stating that my appeal was allowed. Now I am waiting for call letter from UKBA. My question is once I get this student visa from UKBA, am I eligible to apply for my PSW IMMEDIATELY? The same thing happened for one of my friend in 2008, when he applied for PSW at a similar situation as like mine, his application was refused raising a question that after successful completion of MBA why he applied for student visa extension that too for a below degree level course. I am much tensed and worried on hearing this from him. Please give me some advice in this. Thanks in advance.

You have nothing to worry about. You can apply for PSW within 12 months of date of award.

that must be the over-simplication of the facts.

In theory, you should not have any problems getting psw.

However onus is on the applicant to remove all the doubts from caseworker's mind. To be on the safe side, in your covering letter, try to tell UKBA when you finished original course and why did u enroll in another course. give him/her satisfactory answers before hand so he/she doesnt have any reason to believe you are not genuine student

PS. the reason that you joined diploma course to STAY in UK will not go very well with caseworker. so come up with better reason!
