Fiance Visa

Post by mada » Sat Jun 24, 2006 3:14 pm

Hi everyone
Just wondering if anyone could advise me on my case and if i have a chance of winning it?

I was in the UK since august 1999 on a student visa. My visa was expired in 31st October 2005. I got graduated in July 2005 and the applied for a jon in the UK. I was offered a job and my employer applied for a work permit in august but it actually got refused. The school did an appeal on it but meanwhile i was an overstayer so i consulted some solicitors in leicester.
They advised me that they will do the appeal and i should not leave the UK. But as time was going by and i wasnt getting a good response from my solicitor, i consulted their head office and the guy in charge was very sorry for me and told me that i had to leave the country as i was an overstayer. I left the UK on the 08th feb 2006.
But meanwhile i started on a relation from december 2005 when i was in the UK and me and my girlfriend decided to get married. Obviously things moved on so quickly and i came back to madagascar which is where my parents live but i have an INdian passport.
So i went to apply for my fiance visa in mauritius as theres no british embassy over here. They refused my application on the grounds that my marriage is subsisting and that i previously overstayed and wont respect UK laws if i come back. The thing is i am not married and decided to do the appeal through my solicitors. I am now awating on a hearing date and also the outcome of the tribunal. Any suggestions????
