Applying for Tier 2 extension after getting Tier 1 general

Applying for Tier 2 extension after getting Tier 1 general

My situation is little peculiar so giving a brief background :

I came to UK since septmember 2010 on Tier 2 ( ICT ) valid upto 30th APril 2011 .

My visa is valid upto 31st May ,2011 .

I intend to apply for Tier 1 General before 6th April 2011 .

But my employer has initiated for my extension and I will be getting a new Certificate of Sponrship by April End .

My Question is : If I get Tier 1 ( General ) can I still apply for an extension under tier 2 ( ICT ) ?

Is it that once I get Tier 1 General I need not worry for any extension application and will be allowed to work for the present employer with the COS .

Appreciate if some one can guide me quickly on this as I need to make a deicison to apply for Tier 1 before this month end .

Why would you need a tier 2 if you already have a tier 1 ?
you dont need it. If your tier 1 is processed withing timelines then it should be fine, you dont need to apply for tier 2.

Now the thing you need to conisder is the processing timelines. You have mentioned you intend to apply for tier 1 so you havent yet done it yet.

In case your tier 1 isnt processed by 30th April, and then gets rejected later on, you might have to go back to your country for you to apply for tier 2 under ICT


P.S - That is my situation and I came on here to post that topic only :)

I meant you might have to go back to your country to apply for tier 2 under ICT

If you are granted leave to remain as Tier 1 (General) migrant, your Tier 2 (ICT) leave will become invalid .. so no question of being able to extend (an invalid) Tier 2 leave.

With Tier 1 (General) leave, you can continue to work with your current employer (or find another employment) without the need for a CoS.

After you are granted Tier 1 (General) status and you continue to remain employed with the current employer, you should inform the employer that you do not need sponsorship (and therefore a CoS) as the employer must inform UKBA and cancel the CoS (as is required of them).
