Limited leave to remain issue

I was granted limited leave to remain on the grounds of my partner who's is a British national back in 2008.We then got married in the same year and have a child whos is now a British citizen.As soon as we got married in 2008 I applied for a spouse visa the same time I was granted LImited leave to remain however at that time i was dealing with a very bad lawyer who send my letter to get a biometric test done late or the due date and my documents where send back and as a result didnt get a refund.My question is will I be able to apply for ILR as I have been married for 2 yrs and my current visa (Limited Leave to Remain) expires Sept of this year?Would I be able to take the life in the UK test and apply for this? Or should I apply for an extension for the Limited Leave to remain?PLEASE HELP
