Please I am a bit confused as to what category my Mum's status fall into, her passport states that leave was granted from the 11th day of Nov 2006 ( and so does mine, I am her dependant son) for one year, this was extended for 4 yrs in Oct 2007, making us due for ILR in sept 2011.

My main questions are:

a) Is she covered by the HSMP JR going by the fact she applied for HSMP before the 7th of Nov 2006 ?

b) If yes , are we then exempt from the LIUK test (at least for now i.e during our application for ILR) ?

I would very much appreciate any informed opinion on the above.

1. If her visa in the passport states effective/ issue date as "11-Nov-06", then it is obvious that she would have applied for HSMP approval much before 07-Nov-06. In other words, she is covered by HSMP JR.

2. In such case, neither your mother nor any dependants need to take LITUK test to apply for settlement.
