hi all,

I will be eligible for ILR in jan 2012. however I am worried about the visa gap that I have. if someone can help me with this it will be helpful.

I applied for tier 1 general visa extension in december 2008, when my initial 2 year HSMP visa was supposed to expire in jan 2009. however my application was returned by 14 feb 2009 stating that the fee amount was wrong. I reapplied immediately with correct amount. but my application was refused stating I had not submitted updated bank statements and I received the letter by march 2009 also stating that i cannot appeal as my visa had expired. i applied a fresh application through a solicitor in few days and I eventually got my tier 1 general visa for 3 years. but I got the letter in june and the stamp is also from june 2009 but ending in jan 2012 (3 yrs from jan 2009).

my query is, when I apply for ILR in dec 2011/jan 2012, will there be any issue about this gap in visa from jan 2009 - june 2009, although most of the time the passport was in homeoffice. will they consider it as overstay?

any advise as to how should I go about my situation? if anyone else had similar situation, can you tell me what you did?
