Spouse Visa - ILR Holder 10 Year Long Residency

Post by jd007 » Sun Mar 06, 2011 1:22 am

My wife has been in UK as my dependant for the last 7 years - of which 4 years on Tier1 General. My ILR on tier 1 general was due next year but recently I completed 10 years in this country. So got ILR on 10yr rule.
My Question is, can my wife apply for ILR or she has to apply for 2 more years on spouse visa? Does she need to give english test, even she has been in this country for 7 years and working as well?

You help on this issue will be much appriciated.

IMHO, she will need to switch to FLR(M) before she can apply for settlement ... which could be immediately after the switch, given that she's been in UK as dependant of Tier 1 (General) migrant for at least 2 years (287(a)(d)).

New English language requirement for partners apply, when applying for leave using FLR(M).

Please wait for others to confirm / correct me.

Many Thanks for you help sushdmehta and this has clarified alot of confusions I had previously :)

If she could apply for for settlement, soon after FLR (M), that would be great. Has any one been in this situation and applied for ILR soon after FLR (M), please post your experience ?

Many Thanks everyone!

I spoke to 2 lawyers about this situation and they think it can be done. But still not sure whether to risk the HO fee and lawyer fee!!!
