ICT & ILR

Post by broccoli » Thu Mar 10, 2011 10:38 pm

Hello ladies & gents,

I would like to have more information regarding ICT, the new April 6 rules and settlement:

1- If the person is currently outside the UK, and he applies as an ICT before April 6 2011, is he eligible for ILR after 5 years? I've read conflicting reports, some mentioning April 6 2010 and some April 6 2011. Mostly, it seems that starting 2010, ICT no longer leads to settlement.

2- If the answer to (1) is no, can someone applying as ICT before April 6 2011, switch to another category at a later stage?
Again, I've read conflicting reports. Some say that starting April 6 2010, ICT can not switch to any category, some say that this applies to applications made after April 6 2011.

Thank you

1. No (245ZH(b)(x)).
2. As per this document (page 9), Tier 2 (ICT) migrants will not be able to switch to Tier 2 (General).

Pardon my ignorance but the document says this rule applies to those who get their T2 ICT visa post 6 April and not to those who are in country.

I've got a few more questions:

- I understand that new rules state that ICT to General is not allowed after April 6. Is this rule applicable only to those trying to switch to General with the same employer, or is it also the case when switching to a different employer?

- What is the list of possible category switches from ICT besides General, provided they yield eventually to ILR?

- If a CoS was assigned in February 2011 (before April 6), but the application for a leave is done after April 6: how does it compare to a CoS assigned after April 6?
