stepchildren of refugees

Post by leech786 » Wed Apr 13, 2011 12:39 pm

Hello All

I am a newbie

I need the following information please:

I am aware that a refugee (with 5 years limited leave) who marries a person abroad after getting refugee status i.e. in a third country can call their new spouse over under the family reunion rules.

However my question is, can that same person with refugee status call their stepchildren over as well (i.e. the existing children under 18 of their new spouse)

If they can do this, would this be under the family reunion rules i.e. rule 352D (relating to children) or would it be under the normal dependant children rules at 296 onwards (if under the latter which rule would it be)

The person concerned is a Zimbabwean national with refugee status; he intends to travel to South Africa to get married to his fiancé who is also a Zimbabwean national (with residence in South Africa). The refugees fiancé has a child under 18 from a previous relationship which she wants to bring with her to the UK after marriage – can she do this?.

Your help would be appreciated

Many Thanks
