Unusual case: full time work placement on student visa.

GF is in possession of a student visa until 2008, as part of her studies she is required to take a placement in Europe (another visa headache for us posted elsewhere here), she is a visa national for every-bloody country in the EU it seems (Russian).

Now we know 20 hrs a week is allowed for working on student visa, but what about a placement such as this where she will be working full time for 12 months but not in the UK.

I can see it's not a problem, cos she's not working in UK, but we are both so stressed out we've started to panic about everything.....

I think it's quite clear, as you say, that the 20 hours work restriction only applies to work done within the borders of the UK.

A bigger problem might be that if she leaves the UK for 12 months for her placement somewhere in Europe, she might lose her student visa as she will no longer be studying at her place of learning.
In a few years time we'll look back on immigration control like we look back on American prohibition in the thirties - futile and counter-productive.

Ohh, fuking hell!!!

One more worry, this German visa/work permit/residence permit is a nightmare!

We have letters galore, mainly for obtaining this visa, from the UK uni saying this 12 mnth placement is part of her recognised course, etc, blah-blah....

Technically tho she is studying - the placement is in Germany to further her German language skills on a live and work basis (degree is that of interpretor/translator in English Russian and German) and if she is the only one who can't go her last year at uni here is going to be seriously compromised....

As we are planning for UPV (another worry) we are being über-careful to ensure many reciprocal visits and she'll be back here in UK as much as her placement will let her.

I'm not sure if this will help, but I have a friend who went thru a similar procedure a few years ago. She was on a student visa & part of her social work training consisted of two placements- one of which was in an EU country. She was able to do this placement in Spain, where she obtained the requisite visa. When she went on to apply for her work permit, a letter from the university & the placement was attached explaining the one year absence as a requisite for her to obtain her degree. She had no problems & further went on to obtaine ILR, also with no problems. Good luck.
