Please help, EEA National wants to bring own family to UK

Post by grigor » Mon Apr 18, 2011 7:47 pm

Hi,

This is my first time posting here so please bare with me,, I have used the search button and i have found other topics but mine kind of differs from the rest.

I'll start from the begging so i dn't miss anything out.

Came to the UK march 2001 From Albania, with my wife and then two children,
Applied for asylum, was refused in 2005
Daughter Born 2006
I was removed from the UK with my Family march 2009.

Now since then, i have bee Living In Greece with my family, i was able to obtain Greek Citizenship through Ancesty (mother was Greek), the same goes for my oldest son 21 and young daughter which was born In the UK, my other daughter has just applied for her self because there was a mix up at the Greek offices so she's had to make a fresh application.

My wife and children have a permanent residence status in Greece and can stay here as long as they want.

Now i will be moving to UK shortly with my son, i am expecting to find/start work and my son will study at Uni, my question is this.

Can my family members, wife and old daughter apply for the EEA permit or Family Settlement, and what are the chances of a permit granted, i understand that the permit is only for 6 months, but i want my family to continue living with me in the UK.

Is there any other types of Visa's/Permits which could apply to me

I highlighted the word 'Removed' because i remember the UK border Agency officer saying to me when they came and took us from our home in 2009 saying that ' You are not deported but removed, there is nothing stopping you come back here tomorrow on a Visa'.

Any help would be appreciated

p.s. where would be the best place to apply.

Best Regards

As you are now a Greek national, there is indeed nothing that stops you to come to live and work in the UK. Your history as asylum seeker is irrelevant.

Your family (wife and children who are under 21 or financially dependent on you) can accompany you (regardless of their nationality) and will be allowed to work in UK as well.

They need to apply for an EEA Family Permit at the visa section of the British Embassy in Athens, and once in the UK apply for a Residence Card. The expiry of the EEA Family Permit will not affect their residence rights, so don't worry about this six months limit. From your story I see no reasons why any applications could be rejected.

Hi,

Thanks for the reply I really appreciate it, how long after i have come to the UK can i apply for the EEA permit, and as far as the embassy is concerned does it have to be the Greek one.

Another question is what is the most important piece of evidence i have to give in order to make my application solid?

I am a bit confused with the permit, as you say the six month period shouldn't worry me, but is that only if I have applied for a residency card during the 6 month period.

Another question which you may know the answer to,Can my daughter (UK born one) apply for her British passport straight away?

may be you can first read the information and guidance on

and
http://www.ukba.homeoffice.gov.uk/eucitizens/

I think most of your questions will be answered there in detail
