Falsely accused of domestic violence by spouse

Post by Jessica1988 » Tue Apr 19, 2011 8:20 pm

Hi, i am writing on behalf of my brother who got married last year to someone from India.

Basically his wife came to the UK in January but left him in March. She has been to the police and has falsely accused him of being violent. My brother is really stressed out and upset, as far as he was aware they were happily married. Her brother boasted about having done this case to gain an indefinite stay to remain in the UK which means that the marriage was a ploy for her to gain entry to UK.

We wanted to know if there is any way of revoking her visa and getting her deported.

All help will be greatly appreciated
Thanks

(I think i have posted this in the wrong section, sorry )

If your brother needs advice it would be better if he posted himself.

sorry i didn't know that only the person facing a problem has the right to ask for help..anyways he would write himself but he is always working nowadays so doesn't have the time..he seems to be doing all this overtime to keep himself occupied so he doesn't think too much about this situation.

It is always easier for someone to seek advice for themselves as they will be more familiar with the facts. If you search the forum you will find some recent posts asking very similar questions.

Hi Jessica,

I understand that there is a new rule in place that people who have had domestic abuse even if they can prove it get sent back to their own country the Government won't keep them here. Only if they have ILR or British Nationality. Also, your brother can write to the home office and withdraw sponsorship and HO will log it on their systems.

Good luck.

Thanks.

There has been no change to the domestic violence rule apart from the change to the criminality threshold. You have already been advised this in your own posts on the subject.
