Can an Indian Tier 1 (G) Holder marry Pakistani PSW holder

Post by ursamyn » Tue Apr 19, 2011 9:47 pm

Hi Friends and Mods,

I know this is a very different sort of query but just wondering any ideas or inputs from anyone to this question.

Now I am an Indian holding Tier 1 (G) and plan to marry this girl who is Pakistani and holding Tier 1 ( PSW ) visa. We both met here.

Now what all complications can arise? what documents would be needed for she getting the dependant visa? I think I am right in saying that she cant change her status here and have to do it from her own country.

Would it better to get a solicitor involved?

Appreciate all your inputs.

Regards.

Dependent needs to go back to home country for switching.

I think solicitor is not required as it is like any other Tier 1 General dependent overseas application.

Submitt copy of passport, visa, marriage certificate and originals of tenancy agreement, evidences of job or business, bank statements etc

Just for your information marriage certificate and maintenance is mandatory but others like tenancy contract and employment proofs are NOT mandatory .

Read the UKBA Tier 1 dependent policy guidance as well.

Assuming you intend to marry in the UK:

From a legal point of view, I guess none. With CoA requirement coming to an end from 09-May, there will be no UKBA / Home Office say in the matter (who is allowed to marry and who isn't). See also Getting married or registering a civil partnership in the UK
Life isn't fair, but you can be!

Two more question here guys,

Is there any time limit to change the status of the dependant after the marraige here in UK.

Some one said within 28 days? is it correct?,

Secondly, is there any visa validity needed to go back and change the status.
Someone said 6 months valid PSW visa should be there on the dependents passport, just in case.

Awaiting your comments.

Thanks

No, I don't think that there is a time limit.

She shouldn't overstay in the UK for longer than 28 days.
