Confused. Tier1 extension or Ilr.

Confused. Tier1 extension or Ilr.

I am currently on tier 1 valid till March 2012. I am a bit confused as to if i should go for tier 1 extension or apply for ILR as i finish 10 years legal stay in UK in Jan 2012. I am just worried if i apply under long residence and home office didnt make a decision before my Tier 1 runs out i will loose out. Can i apply for long residence in Jan and if by march 2012 home office don't make a decision i can lodge Tier 1 extension application while the first one is pending.is this possible. Experienced members please input your advice. Thanks.

1- If you have completed continues 10 Years Then Yes you can apply for ILR based on 10 Years Long Residency Rule.

2- It does not matter even if you Tier 1 Runs out as by law if you are extending or Appealing, your Status remain the same in you case Tier 1

3- But It's High unlikely that you will get refused on 10 years ILR, Even so if you do get refused you can apply for Tier 1 Extension. But as said it;s highly unlikely that you will have any problem

4- But Having Said so Was your stay a Continues Stay as there are few rule's that can affect you. For Example "the period of time you have spend outside the UK".

Thanks for the quick reply mate. Yes i have not spent more than 104 days out of uk. I have my file from the home office and all my visa extensions were made in time within the country. I am 99 % sure i am eligible but you know that 1% fear is bugging me.

Also i am not too sure if i can apply for extension if i am refused under long residence. By the time home office makes a decision for long residence and if i am refused my tier 1 would already have expired. I am not sure i will be able to make fresh application. I also know when it comes to making a decision on long category applications ukba can take upto a year for processing.

Hi mate please have positive thinking it will be unlikely that you will get refused for ILR .
To clear your confusion the best thing for you is that you can apply i think 30 days before your 10 years complete.
2nd apply on the desk if you got all the paper work ready for ILR So you will get it on the same day
Third if you still confused and dont want to apply 2nd option then keep the money in your account and keep your records up to date meaning tax and selfemployment thing and if they dont give you for some reason which i dont think so than you can lodge your tier 1 extension.
But brother trust me you will be ok they wont change that rule because its a european law long residency ok .
