Problem Here? I am T1(G) & Spouse already in UK on tier2

Post by t1s2010 » Mon Apr 25, 2011 5:03 pm

Friends,

One of my friend mentioned today, that as per updated/old (I am not sure) rules, I may be running in to a problem here.
Self:
1) I am currently not in UK.
2) I am holding T1 (G). Valid from 20Dec, 2010 (applied Sep, 2010)
3) Planning to go to UK in July mid/end, 2011

Spouse:
1) She is currently in UK. Traveled on 10th April, 2011)
2) She holds T2 (ICT). Valid from 5 April, 2011. Applied on 22nd March, 2011.)
3) Her assignment is for couple of years.

My friend told me that as per rules -
both spouse and main applicant shld have the same visa if they are staying for more than 3 months

So, is it true that I am having an issue if I am coming on T1(G) for job there? I will search for jobs once I land there.

Is it some new rule and will it impact us too? (Considering that both of us had visa before 6th April, 2011).

I was chatting with one of my friend; and he highlighted this possibility.

When I tried to google over site:immigrationboards.com as well as general google, I found some three-month mention only for EEA (EU citizens).
it says, a EU citizen can come to UK 'up to three months'; post this some work/study etc docs needed.

However, I couldn't find the rule for non-EU.
There has been so many changes in rules this month, I don't want to live with ignorance bliss.
Hence, I am seeking forum members' views.

Can you please ask your question again as to what doubts you have.

You and your wife both have valid leave to remain in the UK in your own rights and you can continue to live... there is no such rule..

Since she is on Tier 2, she can live as long as her visa is valid.

You can live in UK as long as your visa is valid.

If anyone wants to become a dependant of each other den he/she will have to apply appropriate leave

Please ask what more doubts you have.

To point out more to you an EU citizen can live as long as they want to in the UK since UK is a part of the EU, only some A8 contries needed Worker Registration Scheme which is going to be abolished from May 2011.

There is no such requirement / restriction / immigration rule that states this or anything remotely similar.
Life isn't fair, but you can be!

Sush is right, there is no such restriction. Both of you can maintain your own sstatus at the same time...

Bullshit! A "High Skilled" holder should not fall for such gibberish.

A "high skilled" migrant is not necessarily highly skilled in immigration laws.
Goodluck.

Highly skilled professional is ALSO aware that Mr. Cameron changes rule with 48-hours ultimatum sometimes (@DEC2010), and changed what-not in the starting of THIS very month of April.
Oh yes!!! your strong emotions surely confirmed that there is NO such rule.

Thank you [iD] for making a point here.
