Status of dependant(s) in UK if PBS migrant dies

Hi Everyone,

I was thinking that if a person on Tier 1 General dies. What will be the fate of his dependants? What do law say about this? Regardless he has received the first extension or not.

Any advise on this according to Immigration rules and Law.

i think i saw a news last year that a nurse who came from phillipine died because of an accident and after her death her whole family including her husband who were dependent on her were asked to leave UK or something like that, but if you go to a lawyer i am sure they can help you out

A person here as a tier 1 dependent is just that, a dependent. If the main migrant leaves the UK, or in this case, dies, then the dependent's leave to remain is arguably no longer valid. If UKBA were to find out that the main migrant had died then they could curtail the dependent's leave.

If the dependent qualifies for leave in any other category then they may apply to switch into that category, although most of the obvious categories (such as tier 2) would reqiure the dependent to return home first.

Unfortunately I think if the dependent doesn't qualify for leave to remain in their own right in another category then they would need to return home.
