EEA Family Permit to Registration Card Questions

Post by bunnymoo » Mon May 02, 2011 10:45 am

Dear Forum,

I've benefitted so much from reading this forum, so thanks to all of you for reading and posting.

I am a non-EU citizen married to an EU citizen and we both live elsewhere in the EU. We have a son who is both an EU and US citizen. Now I've just landed a good job in the UK. Our plan is to register there -- I will live there for 6 months and I will after I receive my residence card start living in both places. My husband will register as self-sufficient in the UK.

From reading the forum I think our application will be OK -- we'll take out the comprehensive health insurance for both of us, and we'll make sure not to leave the UK for more than 6 months at a time.

I do have a lot of concerns and questions though that perhaps someone could answer.

* I need to get a "certificate of application" and "application registration card" stating I have the right to work in the UK which should come after I apply for a Residence Card. Does anyone know if I have to ask for this specifically, and how long it takes after sending in the application? Can I really just send a photocopy of my passport to get this so that I don't have to spend a month waiting in the UK to start working? Can I apply in Croydon for one day service and receive this certificate? Would hiring an attorney speed things up?

* For the "Where do you live in the UK?" question, can I put somewhere where I only have a 6 month lease? I imagine that would be OK

* for evidence regarding my husband's ability to be self-sufficient, we will submit bank statements from our accounts. Is it alright if these are printouts of electronic statements, or is it necessary to have paper statements in hand?

*when I apply for a EEA family permit, the advice I've seen on the forum is to put our length of stay at under 3 months -- that this makes the process easier. Will the family permit nevertheless be valid for 6 months anyway?

Thanks very much for your help.

Is my understanding your EEA spouse doesn't need to register, however you are encourage to apply for this:

http://www.ukba.homeoffice.gov.uk/sitec ... s/eea/eea2
and how long it takes after sending in the application?
* Family permits are issued within days, depending where you are living and are valid for 6 months.
* Residence Cards, some OP have indicated it's taken 3 months, and are valid for 5 years. However, UKBA indicates this:

Processing times:
The time taken to process your application will depend on the type of application you make and how you submit it. We deal with all applications within 6 months. Some applications will be resolved much sooner.

To help us to focus on deciding applications as soon as possible, please do not phone or write to ask about the progress of your application unless you need a passport or other document urgently.

If you are admitted with a FP, then you can start working immediately.

Can I apply in Croydon for one day service and receive this certificate?
If you are referring the £300 service, I don't think is yet in effect.
Would hiring an attorney speed things up?
Short answer: NO.
Long answer: What are they really going to do?

Some of the gurus might have to help you here!!!

I hope my 2 cents could be of any help.
Life is short, so let's get moving!

Thanks a million Jrge.

Now we're starting the process with the intention that my husband will set up a residence in the UK (bank account, insurance number, etc) and come there on the weekends but still continue to work during the week in his native EU country.

Does anyone have any insight into the problems this might cause? I mean, will someone in the UK care to check that he is not working somewhere else, or living somewhere else for half of his time and flying in on the weekends? What are the ways to prove residency if we ever need to do that somewhere down the line?

Thank you!!
