ILR(06-04-2011)- Age points confusion

Hi,

My HSMP was grated in Sept2007 (Age=under28yrs) & My Tier 1 was granted in Aug 2009 (Age =under30yrs)

Regarding the Age in SET (O) form – as per the Table 2 (in IDI chapter6), points for 30 or 31 years of age are 5.

And on page 7 (in IDI chapter6) under “Ageâ€

Please tick the relevant box to confirm the points you are claiming on the basis of your age at application for your first grant of leave in a relevant route"

Age
If the applicant was first granted leave in the categories of Highly Skilled Migrant, Writer, Composer or Artist, Self-employed lawyer or Tier 1 (General) Migrant and has not been granted leave in any category other than those listed here since the first grant of leave, points will be awarded based on the applicant’s age at the date of the application for that first grant of leave.

Both documents refer to "age at application for first grant of leave". In your case, that date was in 2007 when you were, as you say, under 28 years of age.

In other words, select the age that applied to you on the day when you applied for HSMP approval.

Hi Sushdmehta,

I got my first WP on 10May 2006 & till 16June 2006 - i did not worked & there after I went to India for 82 days & I returned back to UK on 06/09/2006; but I joined the company from 1st Oct 2006.

I did not received any holiday pay & i dn't have any pay slip for not working for Initial month. But I do have P60 from April 2006 to March 2007.


So my question is - will this be of any concern in PR processing ? - I have a meeting scheduled this month.

If Case work can generate or ask a question regarding this - then what type of documentation i might have to get from my First WP company or else what i can say to the Case work ?

Please guide me on this.

Are you sure the date highlighted in blue is correct? If so, your WP expired in June, then did you get a new WP to start work in October?

I am so sorry for writing it wrongly.


I got my first WP on 10May 2006 - but i did not started working as I was not well; & then on 16June 2006 i went to India (as my Father met with an accident) - i came back from India on 06/09/2006 (almost 80 days off); but I joined the company from 1st Oct 2006.

1. Shouldn't be a problem.
2. The period in question should be treated as absence from UK (unpaid leave).
3. Get a letter from employer that the absence was authorized even if it was personal and unpaid.
4. This absence will not be disregarded by the caseworker (unlike paid annual leave and official overseas assignments generally are) and will be taken into consideration when assessing your absences from UK to fall within the 180 days limit.
