Hello,

If someone had overstayed their visa before in France, and got caught while leaving the airport, and didn't get deported (left to take the plane), but actually got registered in the SIS file,

(a) would their long term visa applied for BEFORE leaving the airport in France, be refused by the ministry of interior once they find his name flashing on their computers? Even the though the employment visa had already been approved before he left by the OFII in France?
(b) would it be impossible for them to get a visa again if his partner applies for him from another European country to come and get married, say Germany or the Netherlands?

The Spouse/Civil Partner visa is initially granted for a (three) year probationary period. Visa holders have unrestricted permission to work or study in the United Kingdom & can also enter & leave the United Kingdom in the coursework of this period without any further permission.Upon completion of the (three) year probationary period, visa holders may be entitled to apply for Indefinite Leave to Stay (ILR). Holders of ILR under this section can apply for UK Nationality two times they have been living legally in the United Kingdom for (two) years with their spouse/civil partner.
