My name is Craig I am 41 years old from the uk, I’ve been separated from my first wife for over 13 years and hopefully my devoice should be finalised within 6 -8 weeks. We are expecting our first baby at the end of May , we need help and information on extending a general visitor’s visa or if it would be possible for her to change the conditions of her stay in the United Kingdom? Our situation is a complicated one as you can see, I’ll start with a brief history of our partnership together . Will first met online at at the beginning of 2009 in February of that year I flew to Thailand and stayed with her for a month at her home. I then flew back in April for a month where we got engaged and then again flew back in November for a month where she applied and got her first visitor’s visa ,she came to the uk and stayed for 6 months then we both went back to Thailand and stayed for 6 months in that time we conceived our baby, but when she was 3 months pregnant we had to come back to the uk quick, and she again could only get a visitors visa which now runs out on 22 June this year.

Your fiancée is not entitled to free medical care so hope you are paying for antenatal care etc. She should be travelling back home to sort out the delivery in her home country, but I expect you have now left it too late to fly. Why did she not return home. It looks to an outsider like you deliberately travelled to the UK to give birth on a visit visa.

You say she came to the UK in a hurry and was issued a visa what was the hurry and what was the basis of the issue, did you say she was expecting a baby.

Looks like baby will be born before visa expires, if your divorce comes through you could both travel back get married and then apply for a settlement visa to return to the UK

Pennylessinindia has given you good advice. If your fiancee uses NHS facilities for antenatel/postnatal treatment or for the birth of the baby she could risk refusal of any subsequent visa until the medical charges have been paid. Is your fiancee over the age of 21? She can't swtich from visitor to Spouse from within the UK.

She was excepted at my Gp practice for 3 months free of charge then was taken on permanently after registration she's been given a NHS number at no stage was we told of any charges to be paid in the future, we have given all the correct information IE photo copy's of passport, visa's etc.

Does anyone know anything about CHAPTER 7 SECTION 1 PERSONS EXERCISING RIGHTS OF ACCESS TO A CHILD RESIDENT IN THE UNITED KINGDOM.

Even if she's been accepted at the GPs - that doesn't mean, in any way, that she'll get the maternity services free.

Even if you’re entitled to free GP treatment in the UK, medical treatment from hospitals will not necessarily be free, unless your condition is considered to be an emergency

You could get a very nasty bill at the end.

Does anyone know anything about CHAPTER 7 SECTION 1 PERSONS EXERCISING RIGHTS OF ACCESS TO A CHILD RESIDENT IN THE UNITED KINGDOM.

She can't switch into that category from visitor status inside the UK either.

If she really cannnot fly, and cannot return to Thailand for the birth, then the only option I can think of is an application for discretionary leave to remain until a reasonable time after the birth, at which point she should return to Thailand and apply for entry.

You could marry while she is still in the UK, so that her application would be for entry as a spouse.

She does face the risk of refusal if they think that she entered the UK as a visitor but with the intention of staying permanently. If she uses free NHS facilities to which she is not entitled, this risk is substantially increased (if not inevitable). Check this site and ask your GP and hospital about charges:
