Bachelor degree confusion--thanks for your advice in advance

Post by Kabira » Sun May 08, 2011 11:11 am

I was given a HSMP visa Jan 2008 for 2 years. Jan 2010 I was given a 3 year extension - expiring Jan 2013.

I was given points for
Bachelors Degree 30 points
Previous earning 25 points
Age 20 points
UK Experience 5 points
Total 80 points.

Now I have been reading that

1) Points will be checked again before granting PR ? is that correct ?

2) If that is the case, I have been told that points for my Bachelors degree will not count ?

I got more worried reading the following paragraph ===>

Any ideas will be great !! thanks

Tier 1 (General) Migrants
This section contains two points tables. Applicants will be required to claim either 75 or 80 points from either Table 2 or Table 3, depending on the date of application for their initial grant of leave:
•
For applications before 6 April 2010 – applicants must score 75 points from Table 2
•
For applications between 6 April 2010 and 19 July 2010 – applicants must score 75 points from Table 3
•
For applications after 19 July 2010 – applicants must score 80 points from Table 3.

For information on the evidence required to demonstrate that the applicant meets the requirements above, see Annex A (1) of this document.
Table 2 – Applications for leave to remain and indefinite leave to remain where the applicant has, or has had, leave as a Highly Skilled Migrant, as a Writer, Composer or Artist, Self-employed Lawyer, or as a Tier 1 (General) Migrant under the rules in place before 6 April 2010, and has not been granted leave in any categories other than these since 6 April 2010

Kabira,

If you got HSMP in Jan 2008, then from this
This table is reproduced from Table 2 of Appendix A of the Immigration Rules.
* An applicant will be awarded no points for a Bachelor’s degree if:
(a) his last grant of entry clearance was as a Tier 1 (General) Migrant under the rules in place between 31 March 2009 and 5 April 2010, or
(b) (i) he has had leave to remain as a Tier 1 (General) Migrant under the rules in place between 31 March 2009 and 5 April 2010, and
(ii) his previous entry clearance, leave to enter or leave to remain before that leave was not as a Highly Skilled Migrant, as a Writer, Composer or Artist, as a Self-employed Lawyer, or as a Tier 1 (Gene
It will mean you will get the points for the Bachelor's degree for ILR as your HSMP was granted before any of the dates listed in Table 2 of Appendix A.

Any senior members should kindly clarify further if necessary.

Kind Regards

Thanks for your reply 2003.
