Both my wife and myself are Indian citizen.

My wife came to United Kingdom on July 2006 on a student visa. She did her nursing here and got her first work permit in November 2007. She then had to change the job in the year 2008 got her second work permit from the second employer in June 2008. This work permit expires in July 2013. She is working full time 40 hours a week as per the contract with the employer and pays Income Tax and NI regularly all throughout her stay so far. Her present work permit on her passport says NO RECOURSE TO PUBLIC FUNDS.

In between she got married to me in February 2010 and I came here on work permit dependent visa in May 2010. I am also employed full time (35 hours a week) with organisation in Bristol and paying my Income Tax and National Insurance every month. My work permit dependent visa also says NO RECOURSE TO PUBLIC FUNDS.

We were blessed by a kid on February 2011.

My questionns based upon above case history is as follows:-

a. When can we apply for Permanent Residency ?

b. If we claim child benefits monthly will it affect us applying for permanent residency ?

c. As my wife gets monthly statutory salary, does this affect us when we apply for permanent residency ?

Nov 2007, clock starts for ILR, so 5 yrs later
b. If we claim child benefits monthly will it affect us applying for permanent residency ?
Yes, you have no recourse to public funds
c. As my wife gets monthly statutory salary, does this affect us when we apply for permanent residency ?
Look up the latest guidance on ILR on UKBA website, as it now has income based criteria as well
