P60 on Tier 2 visa for ILR

Post by jack_daniel » Wed May 11, 2011 3:03 pm

Hi All,
I have a genuine question to ask which includes the Tier 2 and ILR process.

1.I'm employed in an Indian MNC and seconded to UK for long term on a WP+Tier 2 visa for past 3 yrs, Will I be eligible to get a P60 and apply for ILR in future?

*Company is paying the taxes on our (Ind Sal + UK p.d's) on behalf of us.

How is it possible to procure a P60 from the employer if part of our Salary is in Rupee and the per diems is in Pounds £ ?

2.I have stayed in company provided accomodation so far.
Hence company has paid for the rent , council tax, E-bill etc..Will I qualify for the ILR process in future if I'm not able to show my name on them ?

1. Your P60 is the summary of your pay in the UK and the tax that's been deducted from it in the tax year. Technically, per diem is not part of your statutory pay and usually structured by employers in a way that these payouts are tax exempt - so a P60 may not be issued (for per diem only).

2. Get a letter from employer certifying that you are living in a "employer provided" accommodation which includes payment of bills and council tax.
Life isn't fair, but you can be!

That's fine but as per the existing UK taxation rules if the employee is working in the UK for more than 2 yrs.
His total salary incl the UK Allowances are taxable.

So we are taxed on our total earned salary (Indian Salary component + per diems).
I have the HRMC Statement which mentions I've been taxed this much amount in the past which company has paid on my behalf.

1.OK, But Does it still make me eligible to hope for an ILR in future without a P60?

2.Will a letter from the employer stating the "employer provided accomodation" including the bills and council tax
meet the requirements for an ILR in future? What if I opt for a separate rented house for the next 2 yrs.

Many Thanks
