Dear all my husband has ILR which was granted on the 4/01/2011 however we love the joy of travelling but getting the visa are a nightmare as in the whole inconvenience of it so we are wondering when can we apply for his British passport he is a Jamaican national and I am a UK national

how long has he been living in UK and on what basis did he got his ILR?????????

He cannot apply for a British passport until he naturalises as a British citizen.

Assuming your husband was never in the UK before 07-Dec-08, then the earliest he may apply for naturalisation is 07-Dec-11, provided he fulfils the requirements for spouse / civil partner.

Hi all thanks for getting back to me my husband came on a spousa visa on the 7/12/08 and applied for ILR on 4/01/11 as my spousa so Im thinking it would be the same route right?? many thanks

oh sorry my husband was in the UK before that date sorry he was an overstayer here then went back to Jamaica in sep 08 we got married appliled and visa was given no appeal route etc will this make a difference then???

If he was an overstayer then he was in breach of immigration rules and any period of stay in the UK before becoming overstayer cannot be included in the qualifying residential period for the purpose of naturalisation.

he will be qualified for naturalization anytime from 8/12/11....
