Hi All

I am in a bit of a mess here. I married a girl from my country of origin. She applied for a spouse visa. Unfortunately I lost my job soon after due to health issues. Although I found another job within few weeks, Immigration officer refused our case.

We went to appeal and the Judge ruled in our favour. However I have now received a letter stating that Home Office has losged an appeal against courts' decision and will take the case to tribunal.

I am in loss, what will happen to my case and what are the chances of me loosing this case. After that what will happen.

Please any advise will be much appreciated

no can answer your question about the chances of you losing the case without knowing what your application was originally refused, why your appeal was allowed and the judge's reasonings, and on what grounds UKBA have appealed.

at this stage UKBA has to be granted permission to appeal first, the will only be granted permission if there is an arguable error of law in the judge's determination. if they are granted permission to appeal there is likely to be another hearing to decide whether there is an error of law in the decision.
